UK Office of Fair Trading Closes Case Against Scottish Dairies

17 Oct - The OFT has closed its investigation into six Scottish dairies previously alleged to have engaged in price fixing and/or market sharing between 2000 and 2003, with no action to be taken against the companies.

In September 2006, the OFT issued a Statement of Objections (SO) which provisionally found that Ballantyne, Grahams, Quothquan, Renfrew, Scottish Milk Dairies and Wiseman had engaged in price fixing and/or market sharing.    

Although the evidence at the time was sufficient for the OFT to make a provisional finding of an infringement, as a result of continuing investigations - which included consideration of the parties' responses to the SO - the OFT no longer considers that it has sufficient evidence to proceed to an infringement decision as set out in the SO. The OFT has also decided that continuing with the investigation would not be an appropriate use of its resources.

No further action will therefore be taken by the OFT in relation to this investigation.
