P&G and Kraft Foods Reach Settlement in Patent Infringement Lawsuit

Cincinnati, Jan. 16, 2009 - The Procter & Gamble Company today announced that they have reached a settlement with Kraft Foods regarding P&G patents to plastic packaging for roast and ground coffee. The settlement covers pending cases related to this matter between P&G and Kraft Foods. The patents protect technology that has helped to drive the success of the Folgers Coffee brand.

In August 2007, P&G filed suit against Kraft Foods, alleging Kraft Foods' Maxwell House plastic container infringed P&G's patents.

P&G and Kraft settled the dispute amicably. The financial terms and the details of this settlement will not be disclosed.

"We are delighted by the terms of this settlement and will not hesitate to do what it takes to continue to protect our intellectual property," said Steve Jemison, P&G chief legal officer.

In November 2008, P&G completed the sale of its Folgers Coffee business to The J.M. Smucker Company.
